Its affiliates and/or their respective suppliers and providers ("Vaamika.com"), and "you" refers to the individual person creating an account with us and/or the customer booking a reservation though us directly through this website, or indirectly through any of our affiliates through whom we provide services. This website is offered to you and is conditioned on your acceptance without modification of the terms, conditions and notices contained herein as they exist at the time the reservation is made. All use of your account by you and utilization by us of the information related to your account together with reservations you book through us are subject to the following terms, conditions and notices. Your use of this website constitutes your agreement to all such terms, conditions, and notices. If you do not agree with these terms and conditions then you are not authorized to use this website. vaamika.com may extend the benefit of the arrangements in this agreement to its affiliates which offer an online travel service under the vaamika.com name in India. The program refers to nascent bookings, associated rewards & services at the resort.

Personal and non-commercial use limitation

This website is for your personal and non-commercial use. The content and information on this website (including, without limitation, price and availability, if any, of travel services), as well as the infrastructure used to provide such content and information, is proprietary to this website or its suppliers and providers. Accordingly, as a condition of using this website, you agree not to use this website or its contents or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your travel itinerary (and related documents) for travel or services purchased through this website, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this website. Terms, Conditions and Warranties
Tax recovery charge

All taxes, duties, and other incidental charges that are levied by the originating or destination country are to be solely borne by the customer.

Eligibility

The program is open only to individuals who are eighteen (18) and older, have a valid email address and have enrolled in the program or made bookings with vaamika.com companies, associations, or other groups may not participate.

General Terms

vaamika.com reserves the right to discontinue the participation privileges of any individual who engages in any fraudulent activity or uses the program in a manner inconsistent with these terms & conditions or any federal or state laws, statutes, or ordinances. Discontinued participation privileges may result in the loss of all accumulated loyalty credits and benefits. In addition to discontinuance of participation privileges, vaamika.com shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary. While you are enrolled in the program, we may communicate with you via email regarding updates on your account or transactions. Loyalty credits do not constitute the property of any participant and may not be sold, transferred, combined with any other member's account, or assigned, and are not transferable upon death, as part of a domestic relations matter, or otherwise by operation of law. Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in India. All issues and questions concerning the construction, validity, interpretation, and enforceability of these terms & conditions, your rights and obligations, or the rights and obligations of vaamika.com in connection with the program, shall be governed by, and construed in accordance with, the laws of India, without giving effect to any choice of law or conflict of law rules (whether of India or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the India. The program is void where prohibited by law. The failure of vaamika.com to enforce any provision of these terms & conditions shall not constitute a waiver of that or any other provision. Vaamika.com decisions as to all questions or disputes regarding program eligibility, earning or redemption of loyalty credits or your compliance with these terms & conditions are final.

Acceptable Payment Methods

By booking with vaamika.com you authorize vaamika.com and its agents to transact with your bank or other payment gateways on your behalf to obtain the necessary information required to process payment, confirm payment, resolve inquiries and billing disputes, and/or as otherwise required to manage the booking. We accept the following payment methods: (i) credit cards with Mastercard or Visa branding (ii) international debit cards with Visa or Mastercard branding which your issuer allows you to use to make purchases online. You will not be asked to provide your online banking user name or password to vaamika.com ("account access data"). Vaamika.com does not want any information regarding your account access data and you agree not to provide us with your account access data. Not all payment methods are available to use for all travel services, travel products, or modifications a customer may request to their transaction

Credit card:

• Credit cards with Mastercard or Visa branding may be used when booking online..
• Your bank or card issuer may require the account holder or the person legally authorized to act on behalf of the cardholder to authenticate and approve the payment.
• The recording and billing of account activity on your credit card is handled solely by your card issuer. International debit card:
• International debit cards may be used when booking online, provided your card issuer permits use of a debit card for online transactions
• Your bank or card issuer may require the account holder or the person legally authorized to act on behalf of the cardholder to authenticate and approve the payment.
• Once payment has been authorized it may appear in your account activity within a few days; however, the length of time required for the deduction of funds and recording of account activity is determined by your bank or card issuer.

Additional Terms and Conditions
General Terms and Conditions.

• Your financial institution may impose an additional fee or other charges to use their payment services ("payment servicing fees"), and you are solely responsible for payment for any and all such payment servicing fees. vaamika.com does not determine or assess such payment servicing fees.
• Payment servicing fees, if any, are not included in the purchase price displayed on your itinerary or the receipts provided by vaamika.com
• Price and availability is not guaranteed until the booking is confirmed.
• Price of products offered are determined by demand-supply dynamics, time & context of booking and subjected to seasonality of the industry. Hence, Vaamika doesn�t offer any guarantee for price being comparable or equal to any other such bookings made for similar product or service offered.
• If payment is completed, but the booking is not confirmed by us, your funds will not be sent to vaamika.com instead, we will facilitate the return of such funds to the originating source via vendors involved. The clients agrees to the terms and conditions of the agencies involved like internet payment gateway service provider, visa & mastercard.
• The client agrees to the fact that the services offered are not typically consumable instantaneously, hence, the payments made are for advance booking rather than for any kind of immediate gratification. The product /service offered would be consumed on agreed date of invoice. Also, physical presence of client on whose name bookings are made is required for rendering of service. In case of absence of client on booking dates, out of any reason, Vaamika still makes arrangements for the services promised and would assume deemed services & the associated provisions. Hence, Vaamika is not liable for refunds in case the time gap between booking date and booked date is too high or client's presence is partial or non-existent.
• Making a successful payment is not a contract, and vaamika.com makes no guarantee that the travel service or product will continue to be available or be available at the same price in the event a booking is not confirmed.
• vaamika.com shall have no obligation to replace the unconfirmed booking, accept another booking in lieu of the unconfirmed booking, or to compensate you for such unconfirmed booking. Any subsequent bookings will be treated as a new transaction and will require a new and separate payment. No booking information will be carried over from any previous itinerary. No payment made for a prior unsuccessful booking can be applied towards your new booking.
• In the event modification of an existing booking for which payment was made results in the need to collect additional funds (for example, a rate increase in a hotel room whether such room was booked alone or in a package), payment for any such additional funds may only be made by (a) a credit card with Mastercard or Visa branding; or (b) by an international debit card, provided your card issuer permits use of a debit card for online or phone transactions. The payment types identified in the preceding sentence must be used to pay any such additional funds, regardless of the original form of payment for such booking.

Modification:

• Modifications in the booking are allowed subject to availability of the rooms or services available on requested dates. Also, Vaamika doesn�t offer any guarantee of the retention of prices of original bookings.
• If modifications are feasible operationally, then refunds are subject to the terms mentioned below in refund section.
• Cancellations:
  Cancellations of the bookings can be made with subject to following conditions.

  30 to 8 days: 40%
  7 to 4 days: 60%
  Less than 4 days: 80%
  
• All the refunds made are subject to the conditions mentioned below in refunds section.
• Refunds:
  
  
• Refunded amounts are generally returned within 7 business days; however, the length of time required for the funds to be credited to your account is determined by your financial institution. Please check with your financial institution on their specific rules regarding returned or refunded transactions.
• Refunds limited to 1 per booking. If your travel arrangements are subject to more than one change, it may be necessary to cancel the entire booking; any eligible refunds will be sent to your financial institution to credit your account in accordance with its policies. Rebooking your travel will require a new and separate payment.
• vaamika.com has no obligation to issue refunds if: (i) vaamika.com received payment ninety (90) or more days prior to our receipt of the refund request for a booking transaction; (ii) the purchase requires more than one refund or credit; (iii) in response to a disputed booking appearing on your statement from your financial institution, your financial institution issues you a refund for the disputed booking transaction and sends vaamika.com a charge back on the transaction (a charge back reverses the payment you made to vaamika.com for the refunded transaction); (iv) the booking is for non refundable travel products or services; (v) you cannot provide us with full and accurate information required to complete the refund or credit; (vi) the refund request has already processed through the vendors involved but has not yet applied to the originating source of the payment; (vii) the refund request directs vaamika.com to issue the refund to a different financial institution than the source where the original payment was received; or (viii) vaamika.com did not received the payment for which the refund request is made due to force majeure or other causes beyond our direct control.
• Refunds requiring special handling may result in a delayed return of the funds: ix. In the event a refund cannot be handled within standard refund protocols or to process a refund after 90 days, you may be asked to supply additional information and to provide documentation of the original charge. Information disclosed to vaamika.com for the purposes of processing a customer refund will be protected in accordance with our current privacy policy.
• All refunds are subjected to processing & service fee of 2.5% of the value refunded.

Modification of these Terms and Conditions

vaamika.com reserves the right to change the terms, conditions, and notices under which this website is offered and you agree to accept and be bound by those terms, conditions, and notices that are in effect at the time of your use of this website and its facilities.

General

This agreement is governed by the laws of India. You hereby consent to the exclusive jurisdiction and venue of courts in India, in all disputes arising out of or relating to the use of this website. Use of this website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and vaamika.com as a result of this agreement or use of this website.
vaamika.com's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of vaamika.com's right to comply with law enforcement requests or requirements relating to your use of this website or information provided to or gathered by vaamika.com with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

This agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between you and vaamika.com with respect to this website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and vaamika.com with respect to this website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Fictitious names of companies, products, people, characters, and/or data mentioned herein are not intended to represent any real individual, company, product, or event. Any rights not expressly granted herein are reserved.

Use of vaamika.com website

The vaamika.com website is provided solely to assist customers in determining the availability of travel-related goods and services and to make legitimate reservations or otherwise transact business with suppliers, and for no other purposes. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this website in accordance with all terms and conditions herein. You agree to be financially responsible for all of your use of this website (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all consumptions of this website by minors under your name or account. You also warrant that all information supplied by you or members of your household in using this website is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities of this website shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. Separate terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier's conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in vaamika.com debiting your account for any costs vaamika.com incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this website.

Currency Converter (when applicable)

Currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes are not updated every day. Check the date on the currency converter for the day that currency was last updated. The information supplied by this application is believed to be accurate, but vaamika.com, its affiliates, and/or their suppliers do not warrant or guarantee such accuracy. Information Collection and Use

Reservation Orders
When you book a reservation through our website, we ask you to provide personally identifiable information by filling out and submitting an online customer profile form. This information includes: your name, home or work telephone number, fax number, email address, and your credit card number, expiration date, and billing address. We use this information to process and book your reservation and to notify you of your reservation status by email or fax. When you return to the site, we will ask for your email address and booking reference and may ask for other key pieces of personally identifiable information to enable you to access your reservation information. To further protect your personal information & make transaction secure, we have created this two step procedure via an email confirmation.

We also ask you for personally identifiable information about other people for whom you are booking reservations. You should obtain permission from these individuals to provide us with their information. We use this information to reserve the room with the hotel or other accommodation, and, if you so request, to send each person an email notification of the reservation

Member Registration
Vaamika.com enables you to register an account with us to become a member. When you choose to become a Vaamika.com member, we will require you to provide certain information and request that you provide other information at your discretion. If you do not provide us with the required information, you will not be entitled to have an account with us and be a Vaamika.com member. The information we may require or request includes at least your name, address, telephone number, fax number, email address, a unique login name, password, and password validation. This information is collected on the registration form for several reasons including: (1) personal identification; (2) to complete hotel and car reservations and fulfil requests for other travel products and services; (3) to allow us to contact you for customer service, if necessary; (4) to customize the content of our website to meet your specific needs; and (5) to conduct research and to make product improvements to the services we offer on our website. Surveys & Contests
Very occasionally, we may request information from you through surveys or contests. Participation in these surveys or contests is completely voluntary and you therefore have a choice as to whether or not to provide this information. The requested information typically includes contact information (such as name and mailing address), and demographic information (such as postcode). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of our website. Terms specific for mobile phone applications (Whenever applicable)
When you use Vaamika.com mobile for iOS or Android (the "Application") we collect and use your information in the same way and for the same purposes we do when you use our website. We also collect and use the following additional information automatically from your use of the Application:

The Application enables us to track the areas you access within the Application which allows us to refine the arrangement of content.  This information is collected anonymously and we cannot identify you from this. The Application also records the phone's unique device identifier (called a "UUID" for iPhones and the "device ID" for Android enabled phones). We will only use the UUID/device ID on the first opening of the Application to confirm to various third parties that the Application has been downloaded and opened.

When you use our' find hotels near your current location’ feature, we use available geo-location data - provided by your phone using GPS or similar technologies to determine your location in order to show hotels nearby. Although this information is collected anonymously, this information may reveal to us your precise location. We only use this information to find and display nearby hotels. We do not collect location data unless you activate the ’find hotels near your current location’ feature within the Application. Sharing of location data can be switched off at any time in the settings menu. If the Application encounters a problem and produces an error, the Application will send us information on this error so we can investigate the error and seek to improve the Application. These error reports tell us information about the handset type and version, the UUID/device ID, the time the error occurred, the feature being used and the state of the application when the error occurred If you do not wish us to collect and use this information via the Application in the ways set out above, please either disable this functionality (where the Application allows you to do so), or remove the Application from your handset and access our website. We look to optimize the Application for iPhone and Android to minimize the data usage

Tags
In conjunction with our own and our affiliates' marketing campaigns, we may also use technology to capture certain information relating to reservations you make through our website. The information we collect is anonymous and will include the total amount of the transaction and the system-generated booking reference. We will use this information to monitor the effectiveness of our marketing campaigns and may pass this on to our affiliates for similar purposes. We may employ a third party service provider to collate and report on the information collected.

Log Files
Like most standard website servers we use log files that collect Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP)' referring/exit pages, platform type, date/time stamp, and number and location on a page of clicks. We use this information to analyse trends, administer the site, track user's movement in the aggregate, diagnose problems with our servers, and to gather broad demographic information for aggregate use. This information is not linked to personally identifiable information. We also use a tracking utility such as ATG Dynamo that uses log files to analyse user movement.

As noted above, established Vaamika.com members may occasionally receive information on products, services, and special deals about which they may be interested. Trip Information and Customer Feedback

If you book a trip through the our website, in addition to notifying you of your reservation status (see "Reservation Orders" above), we will send you an email prior to your date of travel, containing up-to-date information relevant to your trip and travel destination which you may find useful; we will on occasion include information about other products and services which may be of interest to you in connection with your forthcoming trip. We will give you the choice to opt-out of receiving these emails for future reservations. In the interests of maintaining a high standard of service for our customers, we may also send you an email once you have completed your travel, so that you can provide us with valuable feedback on your travel experience, although again, we will offer you the choice of not receiving this.

Newsletter
If you wish to subscribe to our newsletter, we will ask you to provide contact information, such as name and email address. Out of respect for your privacy, we provide a way to opt-out of these communications. Please see the "Choice/Opt-out" section below.

Service Announcements
On rare occasions it is necessary to send out service-related announcements. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these non-promotional communications, although you can deactivate your membership.

Aggregate Information (non-personally identifiable)
We share aggregated demographic information with our business partners and advertisers. This is not linked to any personally identifiable information.

Authorised Service Providers
We share your personally identifiable information with authorised service providers that perform certain functions or services on our behalf. For example, we use an outside a credit card processing company and bank cheque processing company to bill you for goods and services. We also rely on service providers to fulfill orders, deliver packages, perform business and sales analysis, and provide marketing assistance.
